[ingodirectors] Clarification on Circular 225

Dear INGO directors and representatives:
(please ignore this email if you have no concerns about Circular 225)

One of our INGO members contacted the NGO Resource Centre with a 
question on Circular No.225/2010/TT-BTCfrom 2010. According to their 
auditor all donations received from abroad should be declared to the 
Ministry of Finance. In order to clarify this interpretation of the 
circular I consulted our partners at PACCOM and they responded quickly 
with a clear answer. If some of you were concerned about the same issue 
-- you should not worry!

Mr Hung (PACCOM) double-checked with a relevant department at the 
Ministry of Finance (in charge of 'Aid Confirmation Certificates'). He 
found out that Circular 225 regulates only non-refundable aid from 
abroad to 'Vietnamese partners'. It is correct that all foreign 
non-refundable aid has to be registered and certified by either the 
Ministry of Finance or Provincial Department of Finance [depending on 
recipient(s)]. However, this is the responsibility of aid recipients 
(Vietnamese partners), and it is not the responsibility of INGOs or 
donors. Funding/donations from overseas to INGOs working in Vietnam are 
not regulated by this Circular.
